Trump travel ban dealt another blow as appeals court rules

The 9th Circuit Court of Appeals included a citation for one of President Donald Trump's tweets in its ruling against his executive order banning travel from several Muslim-majority nations.

The New York Times notes that "the rules for admitting people from the six countries covered by the latest travel ban [who were also covered by the previous ban] have remained nearly entirely unchanged".

The ruling on Monday from the three-judge - Judges Michael Daly Hawkins, Ronald Gould and Richard Paez - panel is yet another stinging loss from a court that similarly refused to reinstate Trump's original executive order on travel in February, reports CNN.

The so-called travel ban was already headed for the Supreme Court as another federal appeals court had ruled against the Republican president, and the Justice Department had asked the high court to hear the case. The 9th Circuit took a similar stance on Monday, writing: "Immigration, even for the President, is not a one-person show".

Rather than focusing on Trump campaign statements as the Virginia-based court did, the 9th Circuit said the language in the executive order itself did not make a rational case for why a travel ban was needed. The decision by a unanimous three-judge panel of the San Francisco-.

Immigration officials would have 90 days to decide what changes are necessary before people from Iran, Libya, Somalia, Sudan, Syria and Yemen may resume applying for visas. Sessions said that the president's executive order is "well within his lawful authority to keep the nation safe".

"Indeed, the President recently confirmed his assessment that it is the "countries" that are inherently risky, rather than the 180 million individual nationals of those countries who are barred from entry under the President's 'travel ban, '" the judge wrote.

Trump has insisted the ban is legal and questioned his own lawyers for bowing to court rulings by issuing a "watered-down" version that was also blocked by courts. But instead it is focused on convincing the Supreme Court to overturn the injunctions against the executive order. In his March ruling striking down the travel ban, a federal judge in Hawaii also held that the suspension of the refugee program was unconstitutional.

It might seem silly of the Ninth Circuit to cite a tweet in its decision, were it not for this press briefing statement from White House Press Secretary Sean Spicer.

In the first brief, the attorneys general oppose the Trump administration's petition for certiorari, arguing that the preliminary injunction against the immigration ban should be maintained and the Supreme Court should not review the decision at this point because it would be premature. "S.C." he wrote on Twitter, referencing the US Supreme Court, which could act as soon as this week on his administration's request to reinstate the order.
