Right to privacy is a fundamental right, declares Supreme Court

"Supreme Court rejects Modi government's attempt to whittle down the right to privacy", the Congress Party's chief spokesperson Randeep Singh Surjewala said in a tweet. Five out of the nine judges on the bench have noted the judgment for its incorrect reasoning in today's judgment. Talking to reporters here, Mr Chidambaram said,"the Aadhaar we conceived was perfectly compatible with the Right To Privacy". He also argued that the freedom of the press has been derived from Article 19 and similarly, the right to privacy can be derived broadly from Article 21. It is not Aadhaar that is inconsistent with the right to privacy but the interpretation of this government of Article 21, which is an invasion of right to privacy.

"It's a big victory for civil liberties in the country".

He said: "This is a blow to the government, because the government had argued that people do not have a right to privacy". "So it can not be 'either-or.' It has to be a fundamental right with narrowly defined exceptions". A far-reaching judgement which will have consequences in various domains, as technology is playing a greater role in our day-to-day lives.

A apex court was hearing a bunch of petitions challenging the mandatory use of digital identity cards, known as Aadhaar, as an infringement of privacy and breach of personal data.

Prasad asserted that like all other fundamental rights, the right to privacy is also not an absolute right.
