Former St. Louis officer Jason Stockley found not guilty in murder case

St. Louis interim police chief Lawrence O'Toole is asking that people upset with the acquittal of a white former St. Louis police officer in the shooting death of a black man demonstrate peacefully.

St. Louis Circuit Judge Timothy Wilson also has ruled both for and against police during his 28 years on the bench. Stockley says he saw Smith holding a gun before the chase began, and that he felt he was in imminent danger when he opened fire. However, a gun recovered from Smith's vehicle only had Stockley's DNA on it, leading prosecutors to contend that the officer planted the gun in Smith's auto.

Wilson says he could not be swayed by public outcry or fear of criticism in the case, which reignited racial tensions that erupted after Michael Brown's 2014 death in nearby Ferguson, Missouri.

"Some Missourians are sure to be pained by today's decision, and others will agree with the ruling, but the fact is that none of us can let it detract from the goals that we all should share-safer streets, where police have the trust of the communities they serve, and a system of justice that's fair to all of our citizens". Stockley pleaded not guilty, saying he acted in self-defense and believed Smith was reaching for a gun in his vehicle.

"During the pursuit, the defendant is heard saying 'going to kill this motherfucker, don't you know it, '" according to the statement. He left St. Louis' police force in 2013 and moved to Houston. Stockley could have been sentenced to up to life in prison without parole had he been convicted.

Wilson said it wouldn't be unusual for Smith to have a gun, writing, "Finally, the Court observes, based on its almost thirty years on the bench, that an urban heroin dealer not in possession of a firearm would be an anomaly". "You all know this ain't right and you all continue to do this to us", he told a St. Louis Fox television station. The judge wrote that the statement "can be ambiguous depending on the context". Police officers who testified during the trial said they wouldn't take off gloves if they were about to handle evidence. A case in OH twice ended with hung juries, and prosecutors have decided not to seek a third trial.

Forensic analysis revealed that Stockley's was the only DNA present on the gun he said belonged to Smith, the criminal complaint said. And at the request of city leaders, all branches of the St. Louis Library have shut down as protests are expected to continue throughout the night.

In Smith's case, the encounter began when Stockley and his partner tried to corner Smith in a fast-food restaurant parking lot after seeing what appeared to be a drug deal.

After he fired, striking Smith in the chest, Stockley returned to the police SUV to retrieve materials to render first aid, but when he came back it was too late.

"I'm disappointed with the court's finding", said Kim Gardner, a local judge whose office investigates all police-involved shootings in the city of St. Louis. Stockley fatally shot 24-year-old Anthony Lamar Smith in December 2011.

Closing arguments by the prosecution asserted the idea that Stockley obviously planted the weapon in the vehicle of the deceased Smith.
