Supreme Court asks father to produce Hadiya on November 27

The court's statement that the issue of Hadiya Jahan's consent will be considered "prime" recognizes the basic right of all women to choose who to marry and what religion to follow. "I will produce Hadiya before the court on November 27", he said. The court eventually annulled Hadiya's marriage and ordered her to return to her parents's home under police guard.

The court is hearing a petition filed by a Muslim man who challenged an order that annulled his marriage on charges of love jihad.

The Additional Solicitor General submitted that this was a case in which the woman has been indoctrinated and hence the court can invoke parental authority even if she was a major. I will be killed anytime, tomorrow or the day after, I am sure.

Last week, Hadiya had recorded a video message saying that she feared death as his father was increasingly getting angry.

Divan said a radicalised, indoctrinated person can not be said to have a free will.

Senior advocate Kapil Sibal, appearing for the Banerjee-led West Bengal government, told the court that the plea has been filed by the labour department of the state as subsidies under these schemes have to be given by them. The petition states that the girl was forcibly converted through Love Jihad and was being lured into joining the Islamic State in Afghanistan. "It was on her own will that she decided not to move out of the house", Mr. Ashokan said.

Senior advocate Shyam Divan, who is appearing on behalf of Haditya's father Asokan, reiterated the call for constitutional obligation.

Jahan had on September 20 approached the apex court seeking recall of its August 16 order directing the NIA to investigate the controversial case of conversion and marriage of a Hindu woman with him. "Courts can not remain silent in plural societies". The special bench of Chief Justice Dipak Misra will today hear a case related to reforms that need to be carried out in the Board of Control for Cricket in India. It is alleged that the woman was recruited by Islamic State's mission in Syria and Jahan was only a stooge.

The CJI, after hearing the heated arguments, directed Hadiya's father to produce her on the next date of hearing, set for November 27.
