Paul Miller, the company's president for liquids pipelines, said the main questions at this point are about how shipping contracts should share project risk between TransCanada and its customers. The state's Public Utility Commission is now awaiting the forensic analysis results from the spill to see whether any of the conditions it imposed on the pipeline's operator, TransCanada, had been violated, one commission official told Reuters.

Producers in the Alberta oil sands region and elsewhere in Western Canada are facing pipeline bottlenecks, forcing increased volumes onto rail cars.

The pipeline may also be more commercially viable given declining heavy oil production in Mexico and ongoing instability in Venezuela, said Zachary Rogers, a refining and oil markets research analyst at Wood Mackenzie, said in a statement.

On Monday, the controversial Keystone XL pipeline route across Nebraska was approved by the Nebraska Public Service Commission. The project had the support of the state's governor, Republican Pete Ricketts, its chamber of commerce, trade unions and the petroleum industry. The administration argued that no further environmental reviews were necessary when President Donald Trump approved construction of Keystone XL.

The Keystone pipeline transports crude oil from Canada to refineries in Oklahoma and IL, and passes through North and South Dakota, Nebraska, Kansas, and Missouri. It's the last major regulatory hurdle facing project operator TransCanada Corp.

The Obama administration refused to permit Keystone XL in 2015, in large part over environmental concerns.

The plaintiffs said the U.S. State Department used an "inadequate and outdated environmental review of the pipeline" from January 2014.
